After belated recognition, the State is now trying to improve the situation of millions of caregivers family or “Family caregivers”. Overview of current and future measures in this area.
The right to breathe
S caring for a person with a loss of autonomy on a daily basis is exhausting, both physically and mentally. This is the reason why the legislator has put in place in 2016 a “right to respite”. The objective: to allow the caregiver to temporarily delegate the support of his loved one, so that he can himself take rest.
In concrete terms, this device allows to finance a relay at home, to pay for one-off access to a day or night reception structure or to provide temporary accommodation in an establishment or in family care. This envelope is however limited to 360 euros per year and per close dependent.
To benefit from this measure, the assisted parent must not only be eligible for the personalized autonomy allowance (the APA), but also that he has reached the ceiling of the possible assistance plan corresponding to his level of GIR, in other words to his degree of dependence. Otherwise, a financial contribution will have to be paid.
A specific leave
Any employee can temporarily cease his professional activity to take care of a disabled relative or a serious loss of autonomy through the “caregiver leave” scheme, which has since replaced 2017 “family support leave”. This mechanism can be invoked to take care of the other member of the couple, a grandfather or a child but also a collateral up to the 4th degree (brother, uncle cousin, nephew…). Despite the lack of family relationship, the accompaniment of an elderly or disabled person with whom the caregiver resides or “maintains close ties and stable ”is also planned. In the absence of any provision in the collective agreement, this absence is limited to 3 renewable months, without being able to exceed 1 year over the entire career. That said, the leave can be divided according to needs.
The social security finance law for 2020 has improved this feature. Exit the required year of seniority. Since then, this leave can be granted regardless of the date of arrival in the workforce. The other black point was the remuneration since the employee is not paid by his employer. The legislator therefore provided for compensation which entered into force on 1 October 2020 and amounted to , 08 euros per day for a single person and at 43, 83 € for a couple. Please note, however, this “daily caregiver allowance” (AJPA) is limited to 52 days out of the whole professional career. The request is made online on the site Caf.fr .
D other aid being deployed
Legislative texts aimed at supporting informal caregivers have multiplied in recent years. We must cite the law aimed at promoting the recognition of informal caregivers, published in Official Journal of 23 may 2019. In particular, it plans to test a “relaying” device, inspired by Canadian-style baluchonnage. The objective is to go beyond the right to respite by allowing the family caregiver to be replaced for several consecutive days with his parent. Forty project leaders have since embarked on the experiment. On the other hand, this law provides for integrating the issue of reconciliation between professional and personal life of assisting employees in collective company negotiations.
The government has also launched in October 2017 its “strategy of mobilization and support in favor of caregivers”. This national plan includes 6 priorities and 08 key measures supposed to enter into force gradually until 2022. In addition to the leave of the informal caregiver mentioned above, the unique national free support number has been set up in particular at 0 500 360 83, just like the Cap’Handéo label promoting companies committed to helping employees.
